Welcome to Mirjeta Makeup Exquisite! These terms and conditions govern your use of our beauty services. By using our services, you agree to comply with these terms and conditions. Please read them carefully.
1. Definitions:
- CLIENT: The recipient of the service
- COMPANY: Mirjeta Makeup Exquisite
- AGREEMENT: The agreement between the Client and the Company for agreed services, confirmed by e-mail or electronic writing
- FEE: The amount payable by the Client to the Company for the service in the Contract
- OCCASION: The event or occasion for which the service has been agreed
- BRIDAL PARTY: Persons in addition to the Client requiring services at the Occasion
1.1. "Mirjeta Makeup Exquisite," "we," "us," or "our" refers to the freelance makeup artist company based in South Africa.
1.2. "Client," "customer," "you," or "your" refers to any individual or entity who engages our services.
1.3. "Services" refers to the makeup artist services provided by Mirjeta Makeup Exquisite, including bridal makeup, special occasion makeup, brow lamination, lash lifts, trials, and makeup consultations.
2. Bookings and Appointments:
2.1. All bookings and appointments are subject to availability.
2.2. To secure a booking, a 50% non-refundable deposit must be paid in advance.
2.3. If a booking is made within 24 hours of the appointment, the client needs to pay the full payment of the service to secure the booking.
2.4. Deposits can be paid via EFT payment or Yoco, and proof of payment must be sent to Jeta@makeupexquisite.co.za or 0790474488.
2.5. Bookings are considered confirmed only upon receipt of the deposit and proof of payment. Failure to pay the deposit within the specified time may result in cancellation.
2.6. Bookings are reserved for 48 hours without payment. If the deposit is not secured within this time, the slot may be offered to another customer.
2.7. Any changes to the booking must be communicated to Mirjeta Makeup Exquisite at least 72 hours before the scheduled appointment, excluding cancellations.
2.8. If Mirjeta Makeup Exquisite is available to stay longer than agreed, the extra time will be charged at her hourly rate of R500/hour. Mirjeta Makeup Exquisite will only provide overtime services upon receiving upfront cash payment and if there are open slots.
3. Pricing and Payments:
3.1. The prices for our services are specified on the price list communicated during the booking process and are subject to change without notice.
3.2. Payment for services can be made via EFT, Yoco, or cash.
3.3. When making payment, please use the client's name, the first letter of their surname, and the booking date as a reference. Proof of payment should be emailed to Jeta@makeupexquisite.co.za or 0790474488, and a booking confirmation will be provided.
3.4. Cheques are not accepted. All payments must be made electronically or in cash.
3.5. Full payment is due on or before the day of the scheduled appointment, unless otherwise agreed upon in writing.
3.6. We reserve the right to refuse services or cancel appointments if full payment has not been received.
3.7. If makeup services go overtime, the client will be charged at Mirjeta Makeup Exquisite's hourly rate of R500/hour.
3.8. Extras such as trials, fake lashes, eyebrow shaping, or body makeup cost extra, as stated on the price list.
3.9. Any additional services required on the event day that were not part of the original booking agreement must be paid in full to Mirjeta Makeup Exquisite. However, these extra services are subject to availability.
3.10. Eyebrow shaping services on the day of the appointment must be communicated in advance to Mirjeta Makeup Exquisite to avoid time complications. Eyebrow shaping will be charged as per the price list.
3.11. Trials are charged separately as indicated.
3.12. Please note that a 20% surcharge will apply to all services on public holidays and Sundays.
4. Bridal Agreement:
4.1. It is recommended that the bride or wedding planner provides Mirjeta Makeup Exquisite with a hard copy schedule listing the names of persons receiving makeup services in the scheduled order. If someone misses their time slot, the client will be informed, and the next person on the schedule will be attended to. The bride's makeup should be done 2 hours before the wedding ceremony to allow time for dressing and photos.
4.2. The schedule is crucial to ensure timely services. Mirjeta Makeup Exquisite will start the service at the agreed-upon time.
4.3. Any additional services required on the event day that were not part of the original booking agreement must be paid in full to Mirjeta Makeup Exquisite, subject to availability.
4.4. Facial hair removal will not be done on the day of the appointment. It is the client's responsibility to ensure facial hair removal is done prior to the appointment
5. Travel:
5.1. Prices exclude travel unless otherwise specified by Mirjeta Makeup Exquisite. Travel fees will be calculated at R8.00 per km according to AA rates. Toll fees will be added to the travel fee and charged to the client's account.
5.2. Accommodation for one night is required if travel to the venue exceeds 3 hours (one way) or if services need to be done early in the morning or finish after 16:00. Accommodation charges will be added to the client's account and should be prearranged by the client.
5.3. Makeup services away from Mirjeta Makeup Exquisite's venue require a room with large windows and natural sunlight. A large table is needed for the makeup kit and tools. All persons booked for makeup will be serviced in the same room.
6. Cancellations and Refunds:
6.2. The deposit is non-refundable for any customer cancellations.
6.3. In case of unforeseen circumstances, Mirjeta Makeup Exquisite reserves the right to cancel or reschedule an appointment. Reasonable efforts will be made to provide an alternative appointment or offer a full refund.
6.4. Refunds for services already rendered will not be provided, except in cases where Mirjeta Makeup Exquisite is at fault.
6.5. Cancellations must be communicated via email.
6.6. If Mirjeta Makeup Exquisite is unable to complete all services agreed upon due to a delayed schedule or missing clients, no refunds or discounts will be issued.
7. Conduct and Liability:
7.1. Clients must provide accurate information about their health, skin conditions, allergies, and other relevant details that may affect the makeup application process.
7.2. Mirjeta Makeup Exquisite is not liable for any adverse reactions, injuries, or damages caused by the use of products during or after the services. Clients must inform the artist of any known allergies or sensitivities.
7.3. We reserve the right to refuse or discontinue services if a client exhibits abusive, disrespectful, or inappropriate behaviour.
7.4. For a large number of clients, an additional makeup artist may be arranged at Mirjeta Makeup Exquisite's discretion.
7.5. Only two persons may accompany a client to the venue.
7.6. Clients and their companions should respect the work and time limits for services and avoid interrupting Mirjeta Makeup Exquisite.
7.7. Children under 12 years old are not allowed at the artist's venue.
7.8. Makeup lessons are conducted on a one-on-one basis. No family members, friends, guests, or drivers are allowed to attend makeup lessons.
8. Intellectual Property:
8.1. Mirjeta Makeup Exquisite retains all intellectual property rights associated with our services, including makeup designs, images, and promotional materials.
8.3. Unless otherwise specified in writing by the client, Mirjeta Makeup Exquisite reserves the right to use photographs or video footage taken of the client for marketing purposes, both online and in print/video media.
8.4. By paying for the services, clients agree to the display and use of their images on social media and the artist's website.
9. Privacy and Data Protection:
9.1. Mirjeta Makeup Exquisite is committed to protecting your privacy and personal information, adhering to applicable data protection laws and our Privacy Policy.
9.2. By using our services, you consent to the collection, use, and storage of your personal data as outlined in our Privacy Policy.
10. Governing Law and Jurisdiction:
10.1. These terms and conditions are governed by the laws of South Africa.
10.2. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the South African courts.
11. Amendments and Modifications:
11.1. Mirjeta Makeup Exquisite reserves the right to modify or amend these terms and conditions at any time. Any changes will be effective immediately upon posting on our website or other communication channels.
11.2. It is your responsibility to periodically review these terms and conditions for updates or changes.By engaging our services, you acknowledge that you have read, understood, and agreed to these terms and conditions.
